General conditions of sale
Object
These regulations form the basis for all courses, outings and events (hereinafter referred to as "events") booked with the Valais Mountain Bike Academy - L. Strebelle (hereinafter referred to as "Valais Mountain Bike Academy"), unless specific written agreements have been concluded for particular cases. These general terms and conditions of sale form an integral part of all individual contracts concluded between the Valais Mountain Bike Academy and the customer.
Registration and payment deadlines
Registration is done online on the offer page, on the website www.academievttvalais.com , by e-mail to academievttvalais@gmail.com or orally. A reservation is considered validated when it has been confirmed in writing by the Académie VTT du Valais by e-mail and the invoice has been paid in full. The invoice, with bank details, is attached to the reservation confirmation.
Payment can be made online by credit card, TWINT, bank transfer or cash. Single-day events must be paid for by the day of the event at the latest. Multi-day events must be paid for 30 days before the event date.
Cancellation of a participant
The customer may withdraw from the offer at any time before the start of the event. The withdrawal declaration must be made in writing.
As a general rule, severe weather conditions such as mud, snow or bad weather are not a valid reason to cancel the event. Cancellations due to weather conditions are therefore not accepted.
For one-day offers, the following cancellation fees apply:
Up to 30 days before the event: right of withdrawal without charge.
From the 30th day before the event: 50% of the event price is due.
From the 14th day before the event: 70% of the event price is due.
From the 3rd day before the event: 100% of the event price is due
For multi-day offers, the following cancellation fees apply:
Up to 60 days before the event: right of withdrawal without charge.
From the 60th day before the event: 30% of the event price is due.
From the 30th day before the event: 60% of the event price is due.
From the 14th day before the event: 100% of the event price is due.
For offers including third party services
(e.g. accommodation, flights, transport, etc.), the aforementioned cancellation fees apply, in addition to any cancellation fees from third-party providers, which will be charged to the customer by the Valais Mountain Bike Academy.
The time of receipt of the cancellation declaration by the Valais Mountain Bike Academy is authoritative.
No refund will be made in the event of cancellation of an event that has already started or for reasons beyond the control of the organizer. The customer is strongly advised to take out cancellation insurance.
Cancellation by the organizer
We reserve the right to cancel or terminate events prematurely in the event of insufficient participation, severe weather conditions, natural disasters, accidents or force majeure events. In the event of cancellation by us, no charges will be applied to either party, and the lesson or tour will be rescheduled for a later date.
Our scheduled sessions are only guaranteed for 3 or more participants. If the session is cancelled for this reason, the client will have the choice between scheduling a private session and paying the price difference or receiving a full refund.
Our camps are only guaranteed from 5 participants per group. If the camp is cancelled for this reason, the client will be fully refunded.
Transaction fees may apply upon refund
No other claims will be accepted.
Conditions of participation
The customer agrees to comply with the following rules:
Participate with a bike in perfect working order.
Wear appropriate safety equipment (wearing a helmet is mandatory).
Dress and take clothes appropriate to the weather conditions, location and season.
Carry drinks, food and personal medications.
Carry the necessary specific equipment and devices, including chargers and charged batteries for electric bikes.
Act under your own responsibility, in particular by assessing whether a section is suitable for your abilities and can be covered, or whether it is preferable to push or carry the bike.
Behave in a manner that is respectful of the environment and other people, including other course participants, hikers and route users.
Inform the guide of any allergies (e.g. to bee stings) before the tour begins.
Follow the instructions of the mountain bike guide during the event.
Have the skills and experience required to participate in the offer.
The Valais Mountain Bike Academy reserves the right to immediately exclude a participant from the event in the event of non-compliance with these rules.
General provisions
Participation in the event is always at the participant's own risk.
Participants acknowledge and accept that the course and duration of the event may be changed at any time, in particular due to weather conditions or the state of the course. They also accept that the return time may be postponed or deferred.
In particular, participants must assess for themselves whether they can safely ride a section of the trail without endangering themselves or others. In case of doubt, it is recommended to inspect the section of the trail beforehand and/or push or carry the mountain bike.
The organizer or his collaborators are not required to guarantee the safety of the course or to report dangers.
Responsibility
The Valais Mountain Bike Academy assumes responsibility towards the participant, as organizer, for the careful selection, organization and acquisition of the agreed routes, services and facilities.
Exclusion of liability
The Valais Mountain Bike Academy declines all liability for damage to the bike and belongings during transport (flight, train, boat, bus, etc.), as well as for theft of the bike while traveling. Insurance for the bike and luggage is the responsibility of the participant. The Valais Mountain Bike Academy strongly recommends taking out travel and luggage insurance. The participant is also liable for damage or loss of rental equipment and test bikes rented from our partners.
The Valais Mountain Bike Academy cannot be held responsible for activities and excursions booked with external service providers at the destination.
As mountain biking is a sport with an increased risk of accidents (falls, collisions with motorized traffic, rock falls in the mountains, etc.), a high degree of personal responsibility and caution is required of each participant.
Furthermore, the Valais Mountain Bike Academy declines all liability for personal injury and material damage linked to a defective condition of the bicycles, including rental and test bikes, given that damage and significant wear and tear may occur during use or transport.
Photo equipment
Le film et le matériel photographique réalisés lors de l’événement, dans lesquels les participants peuvent être représentés, peuvent être utilisés par l’Académie VTT du Valais à des fins de documentation et de publicité sous quelque forme que ce soit, à condition qu’aucune opposition n’ait été exprimée par le participant.
Final provisions
The Valais Mountain Bike Academy reserves the right to modify these general terms and conditions at any time. If certain provisions of these general terms and conditions are or become invalid, the validity of the other provisions will not be affected. In this case, the invalid provision will be replaced by a substitute provision that corresponds as closely as possible to the subject of the agreement, or comes close to it, and which would have been agreed by the parties if they had known that the initial provision was invalid, in order to obtain the same economic result.
The Valais Mountain Bike Academy and the customer undertake, in the event of a disagreement, to attempt an amicable settlement before resorting to the courts and to allow the other party to make a sufficient written statement. This provision, as well as all underlying individual contracts, are governed by Swiss law. The place of jurisdiction for all disputes arising from this contract is the court competent for the headquarters of the Valais Mountain Bike Academy.
